By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

• All activity under your account
• Providing accurate and up-to-date information

We may suspend or terminate accounts that provide false or misleading information.

You retain any ownership rights you hold in content you upload, import by link, submit through a connected account, or create using the Service ("User Content"). Importing third-party content does not transfer its ownership to you or to IMABIRD Productions.

You grant IMABIRD Productions a worldwide, non-exclusive, royalty-free license to:

• Host, store, and process your content
• Display and perform your content
• Modify your content as necessary to operate, improve, and provide the Service

This includes use of User Content to develop, train, and improve machine learning and artificial intelligence systems, as further described in our Privacy Policy.

You represent and warrant that:

• You own the content or have obtained all permissions, licences and other lawful authority required for the uses you request
• Your content does not violate any laws or third-party rights

Upload, Import and Publishing Permissions

You are responsible for checking and obtaining the rights required before uploading, importing, editing, processing, exporting, scheduling or publishing content. This applies to local files, pasted links (including YouTube, Twitch, Google Drive and Dropbox), connected accounts, API requests and automated workflows.

• Your permission must cover the requested download and copying, storage, AI processing, editing and any distribution or publication, including music, footage, images and other material within the content.
• Obtain required permissions from people featured in the content and meet applicable privacy, data-protection, confidentiality and publicity-rights requirements.
• Comply with applicable law and the source and destination platforms' terms. Do not bypass access controls, download restrictions or other safeguards.
• Review your content, destination accounts and publishing schedule before authorizing publication. You remain responsible for the rights needed when a scheduled post is published.

A publicly accessible link, possession of a file, a connected account or a successful import is not proof of permission. IMABIRD provides the technical tools; accepting or processing your content does not certify that you own it or have permission to use it.

You are responsible, to the extent provided by applicable law, for infringement or unlawful use caused by your failure to obtain the necessary rights or comply with these obligations. We may request evidence of permission and restrict imports, remove content or suspend access where necessary to address a rights complaint or legal obligation. The Service may use artificial intelligence ("AI") to generate, transform, or enhance content.

Experimental Nature

AI features are experimental and provided for informational and creative assistance purposes only.

No Accuracy Guarantee

AI-generated outputs may be inaccurate, incomplete, biased, or misleading.

We make no guarantees regarding correctness, reliability, or fitness for any purpose.

No Professional Advice

AI outputs do not constitute legal, financial, medical, or other professional advice.

User Responsibility

You are solely responsible for:

• Reviewing and validating AI-generated outputs
• Deciding how to use or act on such outputs

Use of AI-generated content is entirely at your own risk.

Output Variability

AI systems may produce different outputs for the same input and may evolve over time.

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes
• Infringe intellectual property, privacy, or other rights
• Upload malicious code or attempt to disrupt the Service
• Reverse engineer, scrape, or exploit the Service
• Circumvent safeguards or access restrictions

We may suspend or terminate access for violations.

The Service, including all software, models, branding, and design, is owned by IMABIRD Productions and protected by applicable laws.

Except as explicitly permitted, you may not:

• Copy
• Modify
• Distribute
• Reverse engineer
• Commercially exploit

any part of the Service.

We may:

• Modify, suspend, or discontinue any part of the Service at any time
• Introduce or remove features
• Make changes for legal, security, or operational reasons

We do not guarantee uninterrupted or error-free operation.

If the Service includes paid features:

• Fees are billed as described at purchase
• Payments are non-refundable except where required by law
• We may change pricing with reasonable notice

Failure to pay may result in suspension or termination.

You may stop using the Service at any time.

We may suspend or terminate your access immediately if:

• You violate these Terms
• Required for legal compliance
• Necessary to protect the Service, users, or third parties

Upon termination, your right to use the Service ceases immediately.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• Fitness for a particular purpose

We do not guarantee that:

• The Service will be secure, uninterrupted, or error-free

• The Service will meet your expectations

To the fullest extent permitted by law, IMABIRD Productions shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of data, profits, revenue, or business opportunities
• Damages resulting from AI-generated content or reliance on it

Our total liability for any claim shall not exceed the amount you paid (if any) for the Service in the past 12 months.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, your mandatory consumer rights, or our own obligations under applicable data-protection law.

If you use the Service for business purposes, and only to the extent permitted by applicable law, you agree to compensate IMABIRD Productions for reasonable, documented third-party claims, damages and costs directly caused by:

• Your upload, import or publication of content without the necessary rights or permissions
• Your intentional or negligent breach of these Terms or applicable law

This obligation does not cover losses caused by our own breach, negligence or unlawful conduct. We will notify you of a relevant claim and give you a reasonable opportunity to respond. This section does not impose a contractual indemnity on consumers or restrict rights that cannot be waived by law.

These Terms are governed by applicable laws in your jurisdiction, unless otherwise required by law.

We may update these Terms from time to time.

Continued use of the Service after updates constitutes acceptance of the revised Terms.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
